Terms & Conditions – Recext-Intelligence
1. Scope of service
Recext-Intelligence provides AI-based sourcing, rating and messaging support for recruiters using platforms such as LinkedIn. The platform is designed to assist decision-making and does not replace LinkedIn or its core functionality.
2. Advisory nature
All outputs, including scores, recommendations and generated messages, are automated and should be considered as advisory only.
3. No guarantees
No guarantees are given regarding accuracy, completeness or suitability of any data, analysis or output.
4. User responsibility
The user remains fully responsible for candidate selection, communication with candidates, hiring decisions, and compliance with applicable laws and regulations.
5. GDPR and data processing
Recext-Intelligence is designed with GDPR principles in mind and aims to support compliant data processing.
The user is free to select and use third-party language models (LLMs) or external AI providers.
Recext-Intelligence does not control or take responsibility for how these third-party providers process, store or transfer data.
If a user chooses to use an LLM or provider that is not GDPR compliant, the user is fully responsible for this choice and any resulting consequences.
6. Use of LinkedIn and third-party data sources
Recext-Intelligence may use third-party APIs and integrations to access and process data from platforms such as LinkedIn, including publicly available data and recruiter-based search results.
The data used is limited to information that is publicly available on LinkedIn or otherwise accessible to the user through their own account or subscriptions.
Recext-Intelligence does not replace LinkedIn and is intended solely to support recruiters in making better decisions within LinkedIn.
Recext-Intelligence is not affiliated with, endorsed by, or officially connected to LinkedIn.
The user acknowledges that use of such data may be subject to the terms and policies of LinkedIn and other platforms.
The user is solely responsible for ensuring compliance with these terms.
7. Third-party services
Recext-Intelligence relies on third-party services, APIs and providers. The platform is not responsible for the availability, accuracy or legality of these services.
8. Service availability
No guarantee is given regarding uptime, availability or uninterrupted access.
9. Limitation of liability
Recext-Intelligence is not liable for any direct or indirect damages, including but not limited to incorrect candidate evaluations, hiring decisions, data inaccuracies, missed opportunities, and regulatory or legal consequences.
10. Indemnification
The user agrees to indemnify and hold harmless Recext-Intelligence from any claims, damages, fines or legal actions arising from use of the platform, use of third-party APIs or LLMs, processing of candidate data, or violation of laws, regulations or third-party terms.
11. Changes
Recext-Intelligence may update these terms at any time.
12. Account security
The user is responsible for maintaining the confidentiality and security of all account credentials, API keys and access tokens.
The user must take appropriate measures to prevent unauthorized access.
Any suspected or actual breach, leak or misuse of credentials must be reported to Recext-Intelligence without delay.
Recext-Intelligence is not liable for damages resulting from compromised credentials.
13. Security incidents and breach notification
In the event of a confirmed security incident affecting user data, Recext-Intelligence will inform affected users without undue delay after becoming aware of the incident.
Notifications will include, where reasonably possible, the nature of the incident, the potential impact, and measures taken or proposed.
14. Suspension and right to refuse
Recext-Intelligence reserves the right to suspend, restrict or terminate access to the platform at any time in case of misuse of the platform, violation of these Terms, or violation of applicable laws or third-party terms.
No liability is accepted for any consequences resulting from such actions.
15. Data retention and deletion
Recext-Intelligence retains candidate data, logs and related information only for as long as necessary to provide the service and for a reasonable period thereafter.
Users may request deletion of their data at any time.
Upon verified request, Recext-Intelligence will delete or anonymize relevant data within a reasonable timeframe, unless retention is required by law.
16. Jurisdiction and applicable law
These Terms are governed by the laws of the Netherlands.
Any disputes arising from or related to these Terms shall be submitted to the competent court in the Netherlands.
17. Contact and Data Processing Agreement (DPA)
For legal inquiries, privacy-related requests or data protection matters, users may contact legal@recext-intelligence.com.
For business customers, a Data Processing Agreement (DPA) can be provided upon request.
